New Mexico Limited (Special) Power of Attorney Form

A New Mexico Limited (Special) Power of Attorney provides a personalized agreement in which the principal grants rights to an agent. The flexibility of this form allows the grantor to state the controls authorized to the attorney-in-fact on an as-needed basis.

Statute – New Mexico Statutes – Uniform Power of Attorney Act (§ 45-5B-101 – 45-5B-403)

Definitions – “Power of attorney” means a writing or other record that grants authority to an agent to act in the place of the principal, whether or not the term “power of attorney” is used (§ 45-5B-102(G)).

Signing Requirements – A notary professional must be available to secure the competence and capacity of all participants in addition to overseeing the endorsements captured within the paperwork (§ 45-5B-105).
