The North Dakota Advance Directive confirms preordained selections regarding an individual’s medical treatment(s) in preparation for an unforeseen occurrence that could leave one unable to communicate their choices. Documenting preferences regarding possible health care courses of action is a standard measure to formulate a plan should a medical scenario arise where the principal party cannot speak for themselves. The arrangement allows the declarant to assess their desires concerning life-sustaining treatment and pain management. It also covers an outline of their spiritual or religious beliefs and anatomical gift expectations to better assist a physician in understanding the needs and wants of the patient. The form provides additional space to designate an appointed attorney-in-fact to make decisions not listed within the agreement officially should the principal be deemed incapacitated. Taking steps to complete the advance directive is a smart and effective way to make known one’s wishes in the event of an unanticipated medical development.

Laws
Definition – “Health care directive” means a written instrument that complies with this chapter and includes one or more health care instructions, a power of attorney for health care, or both (§ 23-06.5-02(5)).
Signing Requirements – This document is classified as enforceable upon execution by the declarant, assigned agent, and either a notary or two (2) subscribing witnesses (§ 23-06.5-05).
