The California Advance Directive has combined the subject matter of the health care power of attorney and living will into one document; therefore, replacing both singular forms. Within this instrument, principal parties can call the shots on what will occur should they ever end up mentally incapacitated regarding feeding tubes, resuscitation efforts, pain management, etc. Also, they may nominate an individual to act as their health care proxy and make medical decisions on their behalf. The principal should confirm that all the fields are filled out accordingly and that the instrument is supplied with the necessary endorsements to instate the agreement.

Statutes – California Probate Code, Division 4.7. Health Care Decisions (§ 4600 – 4806)
Definitions – “Advance health care directive” or “advance directive” means either an individual health care instruction or a power of attorney for health care. (§ 4605).
Signing Requirements – Must be signed either in the presence of a notary public or two (2) qualifying witnesses (§ 4673(3)).
